Organizer Terms

An "Organizer" is a user who creates, publishes, manages, promotes, or operates an event or other organized sports activity using Athletes Around.

Organizers are independent users or organizations.

Except where Athletes Around expressly agrees otherwise in writing, Organizers are not employees, agents, representatives, partners, joint venturers, franchisees, or contractors of Athletes Around.

Using Athletes Around does not create an employment, agency, partnership, joint venture, fiduciary, franchise, or similar relationship between an Organizer and Athletes Around.

Organizers may not represent that Athletes Around sponsors, operates, approves, certifies, or endorses their event unless Athletes Around has expressly authorized that representation.

Athletes Around provides technology that may enable Organizers to:

• Create sporting events
• Publish event listings
• Manage tournaments, leagues, camps, tryouts, and other activities
• Create divisions
• Establish registration requirements
• Accept registrations
• Manage teams and participants
• Collect payments through supported payment systems
• Manage waivers
• Schedule games
• Create brackets
• Track standings
• Record scores
• Conduct participant check-in
• Publish announcements
• Communicate with participants
• Process or manage refund requests
• Display schedules and results
• Use other event-management functionality

The Organizer is solely responsible for the planning and operation of its events to the extent required by applicable law.

This includes responsibility for:

• Event organization
• Venue selection
• Facility arrangements
• Scheduling
• Staffing
• Officials or referees
• Coaches
• Volunteers
• Security where appropriate
• Participant supervision
• Emergency planning
• Athletic equipment
• Eligibility requirements
• Registration requirements
• Rules of competition
• Permits
• Licenses
• Insurance where appropriate or required
• Participant safety procedures
• Medical or emergency arrangements where appropriate
• Compliance with applicable laws
• Participant communications
• Event cancellation decisions
• Refund policies
• Other matters relating to the actual operation of the event

An Organizer may only create or manage an event if the Organizer has authority to do so.

You may not falsely claim to represent:

• A school
• College or university
• Professional organization
• Team
• League
• Conference
• Club
• Facility
• Business
• Government entity
• Nonprofit organization
• Other organization

Athletes Around may require Organizers to complete identity, organization, business, payment, or other verification before accessing certain Organizer features.

Verification may be required before an Organizer can:

• Publish certain events
• Accept paid registrations
• Receive payouts
• Represent a verified organization
• Receive a verification badge
• Access other restricted functionality

Organizers must provide accurate and reasonably complete event information.

Depending on the event, this may include:

• Event name
• Organizer
• Sport
• Event type
• Dates
• Times
• Venue
• Location
• Divisions
• Age groups
• Gender classifications where applicable
• Team or participant requirements
• Registration price
• Registration deadline
• Capacity
• Refund policy
• Rules
• Waivers
• Schedule
• Contact information
• Other material participation requirements

Organizer functionality may be available for activities such as:

• Tournaments
• Leagues
• Camps
• Clinics
• Tryouts
• Showcases
• Training events
• Competitions
• Other approved sporting activities

Organizers are responsible for establishing realistic event and division capacity.

If the Platform allows Organizers to specify maximum teams, maximum participants, maximum teams per division, or other capacity limits, the Organizer is responsible for ensuring those limits accurately reflect the event's operational capacity.

Organizers must not intentionally oversell event capacity.

Organizers are responsible for establishing lawful and appropriate registration requirements.

Organizers may request information reasonably necessary to operate an event.

Organizers should not request sensitive personal information that is unnecessary for event administration.

When registering Minor Users, Organizers are responsible for complying with applicable requirements involving parental or guardian authorization.

Organizers are responsible for establishing and enforcing eligibility rules for their events.

Eligibility criteria may include:

• Age
• Grade
• Sport
• Division
• Team affiliation
• Competition level
• Gender classification where lawful and applicable
• Roster requirements
• Other legitimate competition requirements

Many sports events involve participants under 18.

Organizers working with Minor Users must maintain appropriate safeguards.

Organizers are responsible for determining whether their event requires:

• Parent or guardian consent
• Parent or guardian waiver execution
• Emergency contact information
• Medical authorization
• Background checks
• Staff screening
• Safe-sport policies
• Adult supervision
• Other protections

Organizers are responsible for establishing safety practices appropriate for their events.

Depending on the activity, this may include:

• Suitable facilities
• Safe playing conditions
• Appropriate equipment
• Qualified personnel
• Emergency procedures
• Appropriate supervision
• First-aid availability
• Emergency contact procedures
• Weather procedures
• Compliance with applicable sporting rules

Organizers are responsible for determining what emergency procedures and medical resources are appropriate or legally required for their events.

Athletes Around is not an emergency service.

Platform functionality does not replace appropriate emergency planning.

Organizers are responsible for determining whether their events require:

• General liability insurance
• Participant accident insurance
• Venue insurance
• Certificates of insurance
• Business licenses
• Event permits
• Facility permits
• Governing-body approvals
• Sanctions
• Other authorization

Athletes Around may provide a standard participant waiver, acknowledgment, or assumption-of-risk agreement for use through the Platform.

Organizers may also be permitted to upload or require an additional event-specific waiver.

Depending on Platform functionality, participants may therefore be required to accept:

• An Athletes Around waiver
• An Organizer-provided waiver
• Both

Athletes Around may maintain records related to electronic waiver and agreement acceptance.

These records may include:

• Participant
• Event
• Agreement
• Agreement version
• Acceptance date and time
• Guardian information where applicable

When creating an event, Organizers may be allowed to select or establish an event-specific refund policy.

The Organizer is responsible for choosing an appropriate policy and honoring the policy disclosed to participants at registration.

The Organizer must not intentionally:

• Advertise one policy and enforce another
• Hide material refund restrictions
• Falsely claim a refund was issued
• Change a policy retroactively for existing registrations without appropriate authorization
• Use misleading refund terms

If an Organizer cancels an event, the Organizer must promptly update the event and communicate the cancellation to affected participants.

The Organizer is responsible for handling refunds as required by:

• The event's stated refund policy
• Athletes Around's applicable policies
• Payment-provider requirements
• Applicable law

Organizers must communicate material event changes within a reasonable time.

Material changes may include:

• Date
• Time
• Venue
• Event format
• Division
• Participation requirements
• Significant scheduling changes

Athletes Around may allow Organizers to accept registration payments using supported third-party payment processors.

Organizers must provide accurate information required for payment processing and payouts.

Payment providers may require additional identity, tax, business, banking, or compliance information.

Organizers are responsible for complying with applicable payment-provider agreements.

Paid registration proceeds may be paid to the Organizer through a supported payment provider.

Payout timing may be affected by:

• Payment-provider processing
• Identity verification
• Bank processing
• Refunds
• Chargebacks
• Disputes
• Fraud reviews
• Reserves
• Account restrictions
• Applicable legal requirements

Athletes Around currently may offer certain Organizer functionality without a Platform fee.

Athletes Around may introduce event, registration, subscription, transaction, service, or other fees in the future.

Any applicable Athletes Around fee will be disclosed as required before the Organizer uses the applicable paid feature or completes the relevant transaction. The introduction of future fees does not retroactively change fees for transactions already completed unless expressly agreed.

Third-party payment providers may charge processing, dispute, refund, payout, currency, or other fees.

Such fees are separate from any Athletes Around Platform fee unless expressly stated otherwise.

The applicable payment provider's terms may determine whether processing fees are refundable.

Organizers are responsible for determining and satisfying their own tax obligations arising from event revenue or other activities conducted through Athletes Around.

Athletes Around may collect, report, withhold, or remit amounts when required by applicable law.

Athletes Around does not provide tax advice.

Participants may dispute transactions through their payment provider or financial institution.

Organizers agree to reasonably cooperate with legitimate chargeback and payment-dispute processes.

This may include providing:

• Registration records
• Refund policy acceptance
• Communications
• Event attendance information
• Waiver records
• Other relevant transaction documentation

Organizers may not use Athletes Around to deceptively circumvent Platform payment, registration, fraud-prevention, or safety systems.

If Athletes Around requires a transaction to occur through a supported payment method, the Organizer may not direct users to another method for the purpose of avoiding applicable Platform requirements.

Athletes Around is not responsible for unauthorized transactions conducted outside the Platform.

Organizers may use Athletes Around to manage team or participant rosters.

Organizers must have an appropriate basis for entering or managing information about another person.

Organizers should not publicly expose sensitive participant information through rosters.

Additional protections may apply to Minor Users.

Organizers using Athletes Around's event-management tools are responsible for reasonably maintaining accurate:

• Schedules
• Court or field assignments
• Scores
• Records
• Standings
• Brackets
• Results
• Other competition information

Athletes Around may provide participant or team check-in functionality, including QR-based check-in.

Organizers are responsible for determining appropriate check-in procedures and verifying participant eligibility when necessary.

A Platform check-in does not constitute an independent identity, age, medical, or eligibility verification by Athletes Around unless expressly stated.

Organizers may communicate with registered participants through Platform features.

Organizer communications must relate to legitimate event or sports purposes and comply with applicable law and Athletes Around policies.

Organizers may not use participant contact information obtained through Athletes Around for unrelated spam or unauthorized marketing.

Organizers may receive personal information about users who register for their events.

Organizers may use this information only for legitimate purposes associated with their events and as otherwise permitted by applicable law.

Organizers must take reasonable measures to protect participant information.

Organizers may not:

• Sell participant information without appropriate authorization
• Publicly expose sensitive registration information
• Use information to harass participants
• Use Minor User information inappropriately
• Retain or use information for unlawful purposes

Organizers and their personnel must comply with the Athletes Around Community Guidelines.

Organizer status does not provide immunity from moderation.

Athletes Around may remove an event or restrict an Organizer account for conduct including:

• Harassment
• Discrimination
• Fraud
• Threats
• Minor safety violations
• Impersonation
• Illegal conduct
• Payment abuse
• Other serious policy violations

Organizers may not use Athletes Around to create events that:

• Are fraudulent or nonexistent
• Promote illegal activity
• Intentionally endanger participants
• Facilitate exploitation
• Violate applicable law
• Infringe another person's rights
• Materially misrepresent the Organizer's authority

Organizers must have appropriate rights to use logos, photographs, videos, names, trademarks, schedules, broadcasts, graphics, and other materials uploaded to the Platform.

An Organizer may not falsely imply affiliation with another organization through unauthorized use of its branding.

Organizers retain ownership of content they create, subject to the licenses granted under the Athletes Around Terms of Service.

Organizers authorize Athletes Around to display and distribute event information as reasonably necessary to operate, promote, and provide the Platform.

Athletes Around may display or recommend publicly listed events through:

• Search
• Discover
• Feeds
• Watch functionality
• Location-based results
• Notifications
• Promotional materials
• Other Platform surfaces

Organizers are responsible for protecting their account credentials and access to Organizer management tools.

Organizers should limit administrative access to authorized individuals.

Notify Athletes Around promptly if unauthorized access is suspected.

Athletes Around may restrict Organizer functionality when reasonably necessary because of:

• Suspected fraud
• Identity-verification issues
• Safety concerns
• Excessive disputes
• Chargebacks
• Participant complaints
• Misleading event information
• Policy violations
• Legal requirements
• Security concerns

Athletes Around may remove, restrict, or unpublish an event when reasonably necessary to protect users, comply with law, enforce Platform policies, or investigate credible allegations of fraud or safety violations.

Where appropriate, Athletes Around may request information from the Organizer before making a final determination.

Athletes Around does not guarantee:

• Registrations
• Attendance
• Revenue
• Participant quality
• Team availability
• Event profitability
• Sponsorship
• Ticket sales
• Facility availability
• Any particular business result

To the maximum extent permitted by applicable law, the Organizer agrees to indemnify, defend, and hold harmless Athletes Around LLC and its owners, officers, employees, contractors, affiliates, and representatives from claims, liabilities, damages, losses, judgments, and reasonable expenses arising from or related to:

• The Organizer's event
• Injury or property damage occurring in connection with the Organizer's event
• The Organizer's personnel
• The Organizer's violation of law
• Materially inaccurate event information
• The Organizer's refund obligations
• The Organizer's violation of these Organizer Terms
• The Organizer's User Content
• The Organizer's infringement of another person's rights
• The Organizer's misuse of participant information

To the maximum extent permitted by applicable law, Athletes Around is not responsible merely because its technology was used in connection with an independently operated event for:

• Event operations
• Coaching
• Officiating
• Participant supervision
• Venue conditions
• Athletic injuries
• Equipment
• Transportation
• Organizer personnel
• Participant conduct
• Weather
• Event cancellation
• Event scheduling decisions
• Other operational matters controlled by the Organizer

Athletes Around may maintain records reasonably necessary for:

• Transactions
• Registrations
• Waivers
• Refunds
• Disputes
• Safety investigations
• Verification
• Fraud prevention
• Legal compliance
• Enforcement

Organizers may stop using Organizer functionality subject to outstanding obligations.

Athletes Around may suspend or terminate Organizer access for material or repeated violations of these Organizer Terms or other Platform policies.

Termination does not automatically eliminate obligations arising from registrations, refunds, disputes, events, or transactions occurring before termination.

Athletes Around may update these Organizer Terms as the Platform evolves.

Material changes may be communicated through the Platform, email, or another appropriate method.

Athletes Around may require Organizers to accept updated Organizer Terms before continuing to use certain Organizer functionality.

These Organizer Terms supplement the Athletes Around Terms of Service.

Organizers must also comply with applicable:

• Terms of Service
• Privacy Policy
• Community Guidelines
• Refund & Cancellation Policy
• Participant waiver requirements
• Payment terms
• Other policies presented through the Platform
