Waiver, Release of Liability & Assumption of Risk

I understand that my participation in any sporting event, game, tournament, league, camp, clinic, training session, workout, open run, tryout, meetup, or other activity discovered, promoted, registered for, or coordinated through Athletes Around ("Activity") is voluntary.

I am responsible for deciding whether an Activity is appropriate for me and whether I am physically capable of participating.

I understand that participating in sports, exercise, training, travel, and other physical activities involves inherent and other risks.

These risks may include, but are not limited to:

• Falls, collisions, and contact with other participants;
• Sprains, strains, fractures, concussions, and other injuries;
• Serious bodily injury, permanent disability, paralysis, or death;
• Overexertion, dehydration, heat-related illness, or other physical complications;
• Unsafe or defective equipment;
• Unsafe playing surfaces or facilities;
• Weather and environmental conditions;
• Actions or negligence of other participants, spectators, coaches, officials, organizers, facilities, or third parties;
• Transportation-related risks;
• Theft, loss, or damage to personal property; and
• Other known or unknown risks associated with participating in athletic activities.

I understand that events and Activities appearing on Athletes Around may be created, hosted, managed, or operated by independent users, organizers, schools, teams, facilities, businesses, or other third parties.

Unless expressly identified otherwise, these parties are not employees, agents, partners, or representatives of Athletes Around LLC.

Athletes Around's role is generally limited to providing technology that facilitates discovery, communication, registration, and related platform services.

Athletes Around does not guarantee the quality, safety, legality, supervision, qualifications, insurance, facilities, equipment, or conduct of any independent organizer or Activity.

I agree to exercise reasonable care for my own safety and the safety of others.

I am responsible for:

• Reviewing event information before participating;
• Following reasonable safety instructions and applicable rules;
• Using appropriate protective equipment when required or appropriate;
• Determining whether I am physically capable of participating;
• Discontinuing participation if I believe conditions are unsafe;
• Seeking appropriate medical advice when necessary before participating; and
• Following applicable laws, facility rules, and Athletes Around policies.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, I RELEASE AND WAIVE CLAIMS AGAINST ATHLETES AROUND LLC AND ITS OWNERS, MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUCCESSORS, AND ASSIGNS ("RELEASED PARTIES") ARISING FROM OR RELATING TO MY VOLUNTARY PARTICIPATION IN AN ACTIVITY DISCOVERED, REGISTERED FOR, OR FACILITATED THROUGH ATHLETES AROUND.

This release is intended to apply to claims arising from risks inherent in athletic participation and, to the extent permitted by applicable law, claims involving the ordinary negligence of a Released Party.

This release does not apply to liability that cannot legally be waived, including liability to the extent caused by gross negligence, reckless conduct, intentional misconduct, or other conduct for which a waiver is prohibited by applicable law.

I understand that injuries or medical emergencies may occur while participating in an Activity.

Athletes Around does not guarantee that medical personnel, athletic trainers, first aid, emergency equipment, or emergency transportation will be available at an Activity.

Independent organizers are responsible for determining what medical and emergency arrangements are appropriate for their events.

If emergency medical care is provided to me, I understand that I may be financially responsible for medical treatment, ambulance transportation, hospital care, and other related expenses, except where another party is legally responsible for those expenses.

I am responsible for my personal belongings while participating in Activities.

To the fullest extent permitted by law, Athletes Around is not responsible for lost, stolen, damaged, or abandoned personal property occurring at an independently operated Activity.

Unless expressly stated otherwise, Athletes Around does not provide or arrange transportation to or from Activities.

Any transportation arranged between users, organizers, participants, parents, coaches, or other third parties is independent of Athletes Around.

I accept responsibility for determining whether any transportation arrangement is safe and appropriate.

I understand that an organizer may require me to accept an additional waiver, release, consent form, facility agreement, or other participation requirement.

An organizer's waiver is separate from this Athletes Around waiver.

Acceptance of this waiver does not replace an organizer's responsibility to obtain any waiver, consent, insurance, permit, or authorization required for its Activity.

Users under 18 may be subject to additional participation requirements.

When required by applicable law or by an organizer, a parent or legal guardian must review and accept applicable participation agreements on behalf of a minor.

A parent or legal guardian accepting this agreement acknowledges the risks associated with the minor's participation and authorizes the minor's participation to the extent permitted by applicable law.

Athletes Around does not represent that a parent's or guardian's waiver of a minor's claims is enforceable in every jurisdiction.

Organizers remain responsible for complying with laws and requirements applicable to minors participating in their Activities.

I understand that verification, moderation, reviews, reports, safety features, or other measures provided by Athletes Around cannot eliminate all risks associated with meeting people or participating in sporting activities.

Verification of an organizer, organization, team, or user does not constitute a guarantee or certification that an Activity or person is safe.

I remain responsible for exercising reasonable judgment before and during participation.

To the fullest extent permitted by applicable law, Athletes Around is not responsible for the independent acts or omissions of organizers, participants, coaches, officials, spectators, facilities, vendors, transportation providers, or other third parties.

Nothing in this waiver is intended to exclude or limit any responsibility that Athletes Around cannot legally exclude or limit.

Athletes Around is not an emergency service and does not monitor Activities in real time.

If I or another person experiences an emergency or immediate threat to safety, I should contact local emergency services immediately.

In the United States, call 911.

Safety concerns involving an Athletes Around account, organizer, or event may also be reported through the platform after immediate safety needs have been addressed.

If any provision of this waiver is determined to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law, and the remaining provisions shall remain in effect.

I understand that I may accept this waiver electronically.

By selecting "I Agree," "Accept Waiver," "Register," or a substantially similar button associated with this waiver, I acknowledge that:

• I have had an opportunity to read this waiver;
• I understand that participation in athletic activities involves risk;
• I voluntarily assume the risks described above;
• I understand that Athletes Around generally provides a technology platform and does not operate independently organized Activities;
• I understand that this agreement includes a release and waiver of certain legal claims; and
• I agree to be legally bound by this waiver to the extent permitted by applicable law.

This waiver should be read together with the Athletes Around Terms of Service, Safety Policy, Community Guidelines, Privacy Policy, and any applicable organizer-specific agreements.

If applicable law provides rights that cannot be waived by contract, nothing in this waiver is intended to eliminate those rights.
